1. Acceptance of Terms

Welcome to Athena. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Athena Team ("we," "us," or "our") governing your use of the Athena mobile application (the "App").

By creating an account, accessing, or using Athena, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use the App.

2. Eligibility

Age Requirements

You must be at least 13 years old to use Athena. By using the App, you represent and warrant that:

• You are at least 13 years of age
• You have the legal capacity to enter into these Terms
• You are not prohibited from using the App under applicable laws

Account Requirements

To access certain features of Athena, you must create an account by providing:

• A valid email address
• A unique username
• A secure password

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3. Description of Service

Athena is a quote hosting platform that allows users to:

• Search and browse historical quotes
• Create and share their own quotes
• Like and favorite quotes from other users
• Build a personal collection of quotes

We reserve the right to modify, suspend, or discontinue any aspect of the App at any time, with or without notice.

4. User Accounts

Account Creation

When you create an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized use of your account
• Be responsible for all activities that occur under your account

Account Security

You are solely responsible for maintaining the security of your account. We are not liable for any loss or damage arising from your failure to protect your account credentials.

Account Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for:

• Violation of these Terms
• Fraudulent, abusive, or illegal activity
• Extended periods of inactivity
• Any reason at our sole discretion

5. User-Generated Content

Your Content

Athena allows you to create, post, and share quotes ("User Content"). You retain ownership of any intellectual property rights that you hold in your User Content.

License Grant

By posting User Content on Athena, you grant us a worldwide, non-exclusive, royalty-free, transferable license to:

• Use, reproduce, distribute, and display your User Content
• Modify and adapt your User Content for technical purposes (formatting, optimization)
• Make your User Content available to other users of the App

This license continues even if you stop using Athena, unless you delete your User Content or account.

Content Restrictions

You agree not to post, upload, or share User Content that:

• Is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
• Infringes on any patent, trademark, trade secret, copyright, or other intellectual property rights
• Contains viruses, malware, or any harmful code
• Impersonates any person or entity or misrepresents your affiliation
• Contains spam, advertising, or promotional material (unless authorized)
• Violates any applicable laws or regulations
• Encourages violence, hatred, discrimination, or self-harm
• Contains sexually explicit content or pornography
• Exploits or harms minors in any way

Historical Quotes

When sharing historical quotes, you should:

• Provide accurate attribution when known
• Not falsely attribute quotes to historical figures
• Respect intellectual property rights and fair use principles

We do not verify the accuracy or authenticity of historical quotes and are not responsible for any inaccuracies.

Content Moderation

We reserve the right, but not the obligation, to:

• Review, monitor, and remove User Content at our sole discretion
• Remove User Content that violates these Terms
• Suspend or terminate accounts that repeatedly violate content guidelines
• Cooperate with law enforcement regarding illegal content

We are not responsible for monitoring all User Content and do not endorse any opinions expressed by users.

6. Prohibited Conduct

You agree not to:

• Use the App for any illegal purpose or in violation of any laws
• Violate or infringe upon the rights of others
• Interfere with or disrupt the App or servers
• Attempt to gain unauthorized access to any portion of the App
• Use automated systems (bots, scrapers) without permission
• Reverse engineer, decompile, or disassemble the App
• Remove or modify any copyright, trademark, or proprietary notices
• Use the App to transmit spam or unsolicited messages
• Harass, abuse, or harm other users
• Create multiple accounts to evade bans or restrictions
• Sell, trade, or transfer your account to another person
• Engage in any activity that could damage our reputation

7. Intellectual Property Rights

Our Rights

The App, including its design, features, graphics, text, and software, is owned by Athena Team and protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes, subject to these Terms.

Trademarks

"Athena" and associated logos are our trademarks. You may not use our trademarks without prior written permission.

DMCA and Copyright

We respect intellectual property rights. If you believe that your copyrighted work has been copied in a way that constitutes infringement, please contact us at athena.support@athena-quotes.com with:

• Description of the copyrighted work
• Location of the infringing material in the App
• Your contact information
• A statement of good faith belief
• A statement under penalty of perjury that the information is accurate
• Your physical or electronic signature

8. Third-Party Services

Current and Future Integrations

The App currently uses Amazon Web Services (AWS) for data hosting. We may integrate additional third-party services in the future, including:

• Apple Sign-In
• Google Sign-In
• Facebook Login
• Payment processors for subscriptions
• Analytics services

Your use of third-party services is subject to their respective terms and conditions. We are not responsible for the practices or content of third-party services.

9. In-App Purchases and Subscriptions

Future Paid Features

We may offer premium features or subscriptions in the future. When implemented:

• All purchases are processed through Apple's App Store
• Subscription terms will be clearly disclosed before purchase
• Subscriptions automatically renew unless cancelled
• Refunds are subject to Apple's refund policy
• We reserve the right to modify pricing at any time

Free Trial

If we offer a free trial:

• You may be charged when the trial ends unless you cancel
• We may limit one free trial per user
• We reserve the right to revoke free trials at our discretion

10. Privacy and Data Protection

11. Disclaimers and Limitations of Liability

AS-IS Basis

• Warranties of merchantability, fitness for a particular purpose, or non-infringement
• Warranties regarding the accuracy, reliability, or availability of the App
• Warranties that the App will be uninterrupted, secure, or error-free

Historical Accuracy

We do not guarantee the accuracy, authenticity, or completeness of any quotes, including historical quotes. Users should verify information independently.

Limitation of Liability

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, or goodwill
• Service interruptions or system failures
• Errors or inaccuracies in content
• Unauthorized access to your account or data
• Actions or content of third parties or other users

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR €100, WHICHEVER IS LESS.

User Interactions

We are not responsible for your interactions with other users. You are solely responsible for your interactions and agree to exercise caution and common sense.

12. Indemnification

You agree to indemnify, defend, and hold harmless Athena Team, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your User Content
• Your violation of any rights of another person or entity

13. Dispute Resolution

Governing Law

These Terms shall be governed by and construed in accordance with the laws of Portugal, without regard to conflict of law principles.

Arbitration

Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in Lagos, Portugal, except where prohibited by law.

Exceptions

You may assert claims in small claims court if they qualify. Additionally, either party may seek injunctive relief in court for intellectual property infringement.

Class Action Waiver

You agree to resolve disputes on an individual basis only, and not as part of any class, consolidated, or representative action.

14. Modifications to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will:

• Update the "Last Updated" date
• Notify you through the App or via email
• Provide reasonable notice before changes take effect

Your continued use of the App after changes constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using the App.

15. Termination

Your Rights

You may stop using the App and delete your account at any time by contacting us at athena.support@athena-quotes.com.

Our Rights

We may suspend or terminate your access to the App immediately, without notice, for:

• Breach of these Terms
• Requests by law enforcement or government agencies
• Extended periods of inactivity
• Technical or security issues
• Discontinuation of the App

Effect of Termination

Upon termination:

• Your right to use the App immediately ceases
• We may delete your account and User Content
• Provisions that by their nature should survive (indemnification, disclaimers, governing law) remain in effect

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the use of Athena and supersede any prior agreements.

18. Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

19. Assignment

You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign these Terms without restriction.

21. Apple App Store Terms

Additional Terms for iOS Users

Your use of the App is also subject to Apple's App Store Terms of Service. In the event of a conflict between these Terms and Apple's terms, Apple's terms shall prevail with respect to your use of the App Store.

Apple's Role

You acknowledge that:

• These Terms are between you and us, not Apple
• Apple has no obligation to provide support or maintenance for the App
• Apple is not responsible for any claims relating to the App
• Apple is a third-party beneficiary of these Terms and may enforce these Terms against you

22. Acknowledgment

By using Athena, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
